The DMCA was immediately taken up as a weapon to land US teachers, students, private citizens, and magazines in court. Their crimes? Private citizens wrote software to watch their personally-owned DVDs on their computers. A PhD dissertation describes security flaws in consumer equipment. A university professor and his class took up the public challenge by the recording industry to demonstrate flaws in their new "unbreakable" technology -- and succeeded. In an unprecedented move, on 16 July 2001 the FBI arrested Dmitry Sklyarov, Russian PhD student, computer scientist, a husband and loving father of two young children, on criminal charges. His crime? He conducted research with a team of programmers to help their Moscow-based employer develop a program. It allows Russian citizens enjoyment of electronic books bought and owned legally, and offered it for sale. Dmitry and his co-workers visited the USA, the land of free speech, in order to give a lecture about their research. His 15 July presentation demonstrated severe security flaws in Adobe eBooks. The day after the presentation the FBI took Dmitry into custody as he and a co-worker left their hotel to fly home to Moscow. He has been denied contact with his family, and was not allowed to speak to the Russian Colsulate until 19 July. Since then (as of 22 July) no one has been allowed to see Dmitry Sklyarov, not even a lawyer. He is currently somewhere in the bowels of the federal pennitentary system. The FBI has charged him with traficking security circumvention devices and have labeled him a "hacker." This case has galvanized numberous civil liberty organizations already fighting the DMCA.
