Memorandum, That James Hall of Bentley within the parish of Arksey in the Diocese of yorke about three months before his death, haveing a mynd and intention to publishand declare, what his will was, touching the disposing of his personall estate and especially of his lease of a farme within the Lordshipp of Bentley called Wrastall; Did nuncupatively by or by word of mouth publish and declare in the p~sence and heareing of diverse credible p~sons (he the said James Hall then being of p~fect mynd and memory). That his mynd & will was, and he did wholly give devise, and bequeath to John Hall his sonne, All that his said Lease of his farme called Wrastall, within the Lordshipp of Bentley aforesaide, and all his right, title, interest and tearme of yeares therein; And then further affirmed, that he was induced soe to give and bequeath his said Lease to his sonne because he had passed away unto Margaret Hall his then wife (being stepmother to the said John Hall) and to her heires, all his land, wch of right should have discended, and comed to his said sonne being valued to be worth foure hundred pounds And then also wished, that his right hand had beene Cutt of, when hee putt his hand to the writings, by wch he passed away his said land; And about the moneth of June last past, being a fortnight before his the said James Hall's Death, he the said James Hall (being then weake & sick, yet of sane memory, and understanding) did againe publish, and declare in the p~nce of John Scales, and Grace Binney & Div~se others that his will and mynd was, and that he did wholly give and bequeath his said Lease, and all his interest and tearme of yeares therein unto his said sonne John Hall, further affirmeing, that he had undone his said sonne by passing away his lands from him and therefore wished againe, that he had lost his hand when he putt his hands to the writings for passing away the said Land; And being demanded and asked by Margaret his wife what he intended for the rest of his children, he made answere, they are like to have enough besides; I intend my Lease to my sonne John onely & wholly; And about three or foure Dayes next before his death John Scales comeing to visitt him, he the said Decd. Did of himselfe againe (being at that tyme also of very p~fect memory & understanding) say to the said John Scales, after this, or the like manner, John thou knowest I have given my Lease (meaneing the Lease of his farme called Wrastall) to my sonne John Hall; I doe here declare, that it is still my will & mynd that my said sonne John Hall shall have the farme, and that not any other p~son whatsoever shall have any thing to doe with it but hee, All wch or the like in effect he the sd decd did Div~se tymes alterate & repeate both in his health, and in the tyme of his sicknes whereof hee dyed.
