Whitenigt to Whitenack Deed

This Indenture made the second day of April in the year of our Lord one thousand seven hundred and eighty seven between John Whitenack and Jane his wife of the county of Frederick and state of Maryland--of the one part and Henry Whitenack of the county of Berkely and commonwealth of Virginia of the other part.

Witnesseth that for and in consideration of the sum of three hundred pounds current money of Virginia to him the said John Whitenach in hand paid by the said Henry Whitenack at or before the sealing and delivery of these presents the reciept whereof is hereby acknowledged. They the said John Whitenack and Jane his wife have and each of them hath given, granted, bargained, sold, aliened, ??, and confirmed and by these presents do and each of them doth give, grant, bargain, sell, alein, ??, and confirm unto the said Henry Whitenack his heirs and assigns forever all that tract and parcil of land situate lying and being in the said county of Berkeley and commonwealth aforesaid adjoining the lands of Bartholomew Fryatte, John Chinoworth and William Pailmore and being part of a larger tract purchased of Wm. Tansheo: the same being bounded as follows.

Viz. Beginning at a white oak tree beginning tree of the entire tract, then leaving the last line of the same North 40° East 59 poles to a white oak bush standing on the said line then leaving the outline of the said tract and leaving thence south 53° East 112 poles to a white oak bush on the edge of a field then south 33 3/4° East 66 poles to three thorny bushes on the west side of Woodfields branch and the third line of the original, the reversing the original lines to the beginning. Containing one hundred acres of land more or less.

And all houses, building, gardings, orchards, yards, meadows, trees, woods, underwoods, ways, paths, water, water sources, profits, commodities, hereditaments, and apertanees whatsoever to the said prin? hereby granted belonging in anywise apurtaining and the ?? and ??. Remainder and remainders, rents, ?? and profits thereof and of every part and parcel thereof.

To have and to hold the said tract of land ??taments and all and singular the primeses before mentioned and with their and every of their apertanances unto him the said Henry Whitenack, his heirs and assigns to the only proper use ?? of him the said Henry Whitenack his heirs and assigns forever. And the said John Whitenack for himself his heirs, executors, and administrators both covenant and grant to & with the said Henry Whitenack his heirs and assigns--that he the said John Whitenack and his heirs the said last parcel of land heredetaments? and all and singular the premises before anu?d with every of their apertan? unto him the said Henry Whitenack his heirs & assigns against the claim and demand of him the said John Whitenack and his heirs and all and every other person and persons whatsoever shall & will and forever hereafter defend by these presents;

And the said John Whitenack and Jane his wife doth hereby further covenant, promise and agree to and with the said Henry Whitenack his heirs shall and will at any time hereafter, at the reasonable request, and at the cost and charges in the law of the said Henry Whitenack his heirs or assigns, make, execute, or cause to be made, done, and granted any further lawfull act, deed, conveyance and apearance whatsoever for the ??ther, better and more perfect conveying and assigning the hereby bargained and sold land and principes.

In witness whereof the said John Whitenack and Jane his wife have hereunto set their hands and sealed this day and year first above written--

Received April the 2nd 1787 of Henry Whitenack, party to the within three hundred pounds current money of Virginia it being the full consideration for the within bargained and sold land and premises.

At a bond contained and held for Berkeley County the 18th day of April 1787. This indenture was acknowledged by John Whitenack and Jane his wife parties thereto she being first privily examined as the law direct which together with the Receipt thereon and or so are ordered to be recorded.
