This Indenture Made the eigth day of June in the year of our Lord one thousand eight hundred and thirty eight--

Between Joseph Whitenah and Ruth his wife of the town of Groveland and County of Livingston State of New York of the first part and Ebenezer C. Swift and Grace his wife of the same place of residence of the second part.

Witnesseth that the said party of the first part for and in consideration of the Sum of thirty five hundred Dollars to them in hand paid by the said party of the Second part--the receipt whereof is hereby confessed and acknowledged hath granted, bargained, sold, remised, released, aliened and confirmed and by these presents do grant, bargain, sell remise, release, alien and confirm unto the said party of the second part and to their heirs and assigns forever all that tract of land situate in the town of Groveland County and State aforesaid and bounded as follows Viz.

Beginning at a post South of the ?? leading from Henry Havens house and in the west-line of lands Belonging to said Havens for a Corner. thence North on the West line of Lot No. Seventy eight in town No. eight in the Seventh range of Townships One hundred and forty three perches to Michael Rouss South east corner thence West with said Rouss line to lands of Settie Rolston thence with said Settie Rolston line and the South line of the School House lot to a Stake at the South east corner of Andrew Heis land thence East from said Corner eighty three Perches to a Small Chestnut Stump thence South fourteen degrees east twenty three perches to an Oak Stake thence North Sixty Six degrees east twenty Seven perches to the road leading from Dansville to Geneseo thence North Seven degrees and to thirty minutes east Nine perches to a Stake. thence east over said road twenty perches to an Oak Stake. thence South five degrees and thirty minutes east four perches and eighty four hundredths of a perch to an oad Stake thence North eighty degrees east fifty perches to the place of Beginning Containing One hundred Acres be the Same more or less--

Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appurtaining and the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate rights title interest claim or demand whatsoever of the said party of the first part either at law or in Equity of in and to the above bargained premises with the said hereditaments and appurtenances to have and to hold the said above granted bargained and described premises unto the said party of the second part their heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second party--their heirs and assigns forever. And the said parties of the first part for themselves and their heirs executors and administrators do covenant grant bargain promise and agree to and with the said parties of the second part their heirs and assigns that the above bargained premises in the quiet and peaceable possession of the said parties of the second part their heirs and assigns against all and every person or persons lawfully claiming onto claim the whole or any part of the above mentioned and described premises the said parties of the first part will forever Warrant and Defend.

June 8th 1838 before me the Subscriber appeared Joseph Whitenah and Ruth his wife and acknowledged that they had severally executed the within instrument and the said Ruth on a private examination apart from her husband acknowledged that she executed the within instrument freely and without any fear or compulsion of her husband. And I further Certify that I know that the persons who made the said acknowledgement are the individuals described in and who executed the within instrument.
