Last Will and Testament of Eli C. Whitnah

I, Eli C. Whitnah of Utica in the county of Seward and State of Nebraska, considering the uncertainty of this mortal life, and being of sound mind and memory, do make and publish this my last Will and Testament, in manner and form following, that is to say:

First... I direct that my funeral charges, the expenses of administering my estate and all my debts be paid out of my personal property. If that is insufficient I authorize my executrix, therein after named to sell so much of my real estate as may be necessary for that purpose.

Second... I give and bequeath to my beloved wife Elizabeth Whitnah during her natural life all of my estate both real and personal to use and control as she sees fit but it is my wish and desire that upon her death all the property she may be possessed of shall be equally divided among my legal heirs.

It is my wish and desire that in case of my death before Nov. 15th 1892 that my said wife will take my place and carry on my present business in partnership with my sons until said date. In case my wife accepts of the provisions of this my last Will it shall be in lieu of all she may be entitle to under the statue.

Third... I appoint my said wife Elizabeth Whitnah my sole executrix of this my last will and testament, hereby revoking all former wills by me made.

In witness whereof I have hereunto subscribed my name, this 7th day of March A.D. 1890.

We, whose name are hereto subscribed, do hereby certify that Eli C.Whitnah the testator subscribed his name to this instrument in our presence and in the presence of each of us, and declared at the same time in our presence and hearing that this instrument was his last will and testament, and we at his request sign our names hereto in his presence as attesting witnesses.
