Last Will and Testament of Joseph Henry Whitnah, Jr.


In the name of God Amen. I Joseph H. Whitnah of the County of Iron and State of Missouri being of sound mind although weak in body and being impressed with uncertainty of life and the certainty of death do make this my last will. I will to my six legal heirs all my real estate consisting of my homestead on which I now live also one hundred acres of timberland all in Iron County Missouri. Namely Joseph Chester Whitnah grandson and a minor, Clara Loretta Whitnah inter-married with Henry C. Twomey, Rufus Henry Whitnah, Marshall Herbert Whitnah, Margart Alice Whitnah, Louis Oscar Whitnah. The said heirs to sell the said real estate when the majority of the heirs shall think best and divide the proceeds with all the heirs equally.

It is further my will that all my personal property of every discription that may be on the farm at the time of my death and also the use of this farm up to the time of the sale without rent shall be given to my daughter Alice Whitnah and son Lewis Oscar Whitnah as some compensation for the care they have taken of me in my old age provided that they pay all my just debts and the tax on the farm. And it is my will that my daughter Margart Alice shall take charge of the minor heirs portion of the estate at the time of sale and shall invest it as she may think best and shall turn it over to him when he becomes of age. If he dies before reaching his majority she shall divide the money with all the other heirs equally.

And I here by appoint my daughter Margart Alice Whitnah sole executor of this my last will.

INVENTORY

INVENTORY of all the Real and Personal Estate of Joseph H. Whitnah deceased, lat of Iron County, Missouri, describing the property, situation and title to the Real Estate, the books and papers, the debts due to the deceased, the names of the debtors, the dates of the contracts, the amount of interest due, and the rate of interest thereon, and all Personal Property of whatever character, made by Margaret Alice Whitnah & Louis Oscar Whitnah Administrators of said deceased, and John Difer and J.H. Dalton Witnesses appointed to aid in making the same.

WE, the undersigned Witnesses, appointed by the Probate Court of Iron County, State of Missouri, to accompany and aid the Administrators in opening and examining the papers and money of Joseph H. Whitnah deceased, late of Iron County, Missouri, and in making and Inventory of them, assembled at the late residence of said deceased, on the 11th day of June A.D. 1897, and then and there performed the duty assigned to us, and certify the foregoing to be a full and complete Inventory of the same.

Affidavit of Executor or Administrator.

BE IT REMEMBERED, That on this 11th day of June 1897, before me Judge of the Probate Court of Iron County, personally appeared Margaret Alice Whitnah and Louis Oscar Whitnah Administrators of Joseph H. Whitnah deceased, late of Iron County, Missouri, who being by me duly sworn, on their oath says, that the foregoing is a full Inventory and description of all the Moneys, Goods, Chattels and Estates, real and personal, Books, Papers, Evidences of Debt and of Title of the said deceased, and of all debts due or becoming due, so far as they can ascertain them* and that they were not indebted or bound in any contract to the deceased at the time of his death, except as stated in the Inventory.
