Ok, I see that, but I think its pushing the definition a bit, don't like that right side 
forming up in new high territory, and the drop in the handle would be a little too 
severe, should be less volatility at that point.  Also, very short for a cup, especially 
in an unfavorable market environment.  Some people would call the last few days of 
upward price movement  a wedge, a bearish formation.

I'll send a couple C&H pointers sometime later today.
