This Indenture Made the seventh day of November in the year of our Lord one thousand eight hundred and thirty four--

Between Joseph H. Whitnah and Ruth his wife of the town of Groveland County of Livingston State of New York of the first part and Samuel C. Culbertson of the same place of the second part.

Witnesseth that the said parties of the first part for and in consideration of the Sum of two hundred and seventy five Dollars to them in hand paid by the said party of the Second part,the receipt whereof is hereby confessed and acknowledged have granted, bargained, sold, aliened, remised, released, and conveyed and by these presents do grant, bargain, sell alien, remise, release, and convey unto the said party of the second part and to his heirs and assigns forever, all that certain tract or parcel of land situate lying and being in Groveland aforesaid and bounded as follows to wit.

on the South by the highway leading east and west by the Presbyterian Meeting House on the west by land of John Thompson on the north by land belonging to Malcom Smith now deceased and on the east by the said Joseph H. Whitnah's a Village lot which contains one half of an acre of land adjoining the meeting house lot. It being the Same lot of land conveyed by the Sheriff of Livingston County to the said Whitnah with the exception of the half acre before mentioned on the east end of said Lot containing eight acres and one half of an acre of land be the same more or less.

Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appurtaining and the reversion and reversions remainder and remainders rents issues and profits thereof; and all the estate, right, title, interest, claim, and demand whatsoever, of the said parties of the first part either in law or in Equity, of, in and to the above bargained premises, with the said hereditaments and appurtenances: To have and to hold the said premises above described, to the said party of the second part, his heirs and assigns, to the sole and only proper use, benefit and behoof, of the said party of the second party--his heirs and assigns forever. And the said parties of the first part for themselves and their heirs, executors, and administrators, do covenant, grant bargain and agree, to and with the said party of the second part his heirs and assigns, that at the time of the ensealing and delivery of these presents, they are well seized of the premises above conveyed, as of a good, sure, perfect, absolute and indefeasible estate of inheritance in the law in fee simple and that the above bargained premises, in the quiet and peaceable possession of the said party of the second part, his heirs and assigns, against all and every person or persons, lawfully claiming, or to claim, the whole or any part therof, the parties of the first part, will forever Warrant and Defend.

On the 7th day of November 1843 before me the Subscriber a commissioner of Deeds in the County of Livingston appeared Joseph H. Whitnah and Ruth his wife and severally acknoweldged that they had executed within instrument and the said Ruth on a private examination apart from her husband acknowledged she had executed the said instrument freely without any fear or compulsion of husband and I further certify that I know the persons who made the said acknowledgement, to be the individuals described in and whoe executed the said instrument.
