This Indenture Made the second day of April in the year of our Lord one thousand eight hundred and thirty four--

Between Joseph H. Whitnah and Ruth Whitnah his wife of the town of Groveland County of Livingston State of New York of the first part and John Morrow of the same place of the second part.

Witnesseth that the said parties of the first part for and in consideration of the Sum of Eight hundred Dollars to them in hand paid by the said party of the Second part--the receipt whereof is hereby confessed and acknowledged have granted, bargained, sold, remised, released, aliened and confirmed and by these presents do grant, bargain, sell remise, release, alien and confirm unto the said party of the second part and to his heirs and assigns forever all that certain tract or parcel of land situate lying and being in the town of Groveland aforesaid and bounded as follows to wit.

Beginning at the South East corner of Said Lot in the center of the highway leading from Geneseo to Dnsville village near a stake which is set nearly Twenty feet west of the said center of the highway aforesaid. running west by land of Philip Traseler Sixteen rods. Thence North on a parallel line with the highway aforesaid Ten rods Thence East by Land of Malcom Smith deceased on hundred and twenty nine and a half feet to land owned by the assignees of Timothy Bartles Thence South by the said Bartles and his assignees land to the center of the highway aforesaid. Thence South by the center of the said highway to the place of beginning containing three fourths of an acre of Land be the same more or less.

Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appurtaining and the reversion and reversions remainder and remainders rents issues and profits thereof. And all the estate rights title interest claim or demand whatsoever of the said parties of the first part either at law or in Equity of in and to the above bargained premises with the said hereditaments and appurtenances. To have and to hold the said premises above described to the said party of the second part his heirs and assigns to the sole and only proper use benefit and behoof of the said party of the second party--his heirs and assigns forever. And the said parties of the first part for themselves and their heirs executors and administrators do covenant grant bargain promise and agree to and with the said party of the second part his heirs and assigns that at the time of the Eusealing and delivery of these presents they are well seized of the premises above conveyed as of a good sure perfect absolute and indefeasible estate of inheritance in the law in fee simple. And that the said premises are free and Clear from all Encumbrances except a Mortgage made by the said Joseph H. Whitnah to David McClemman for the payment of three hundred dollars in November 1835. Which Mortgage is to be paid by the said John Morrow And that the above bargained premises in the quiet and peaceable possession of the said party of the second part his heirs and assigns against all and every person or persons lawfully claiming onto claim the whole or any part of the above mentioned and described premises the said parties of the first part will forever Warrant & Defend.

On the 4th day of April 1834before me the Subscriber a commissioner of Deeds in the County of Livingston appeared Joseph H. Whitnah and Ruth Whitnah his wife who acknoweldged severally that they had executed the within instrument. And the said Ruth Whitnah on a private examination apart from her husband acknowledged she executed the said instrument freely and without any fear or compulsion of her husband. And further I certify that I know the persons who made the said acknowledgement to be the individuals described in and who executed the said Instrument.
