Whiteneck to Mong Deed
This Indenture made this twentyfourth day
of November in the year of our Lord one thousand
seven hundred and ninety Eight Between Henry Whiteneck and Margaret his wife of the county of Berkeley
and commonwealth of Virginia of the one part
and George Mong of the said county and commonwealth
aforesaid of the other part. Witnesseth that
for and in consideration of the sum of one
thousand Dollars to him the said Henry Whiteneck
in hand paind by the said George Mong at
or before the sealing and delivery of these
presents the receipt whereof is hereby acknowledged:
they the said Henry Whiteneck and Margaret
his wife have and each of them hath given,
granted, bargained, sold, aliened, en? and
confirmed, and by these presents do and each
of them doth give, grant, bargain, sell,
alein, en? and confirm unto the said George
Mong his heirs and assignes forever all that
tract or parcel of Land situate lying and
being in the said county of Berkeley and
commonwealth aforesaid adjoining the Lands
of Bartholomew Fryatt, John Chenoweth and
William Gilmore and being part of a larger
tract purchased of William Tamber the part
hereby sold being bounded as follows: Viz,
Beginning a white oak the beginning tree
of the entire tract then reversing the last
line of the same north 40º east 59 poles
to a white oak bush standing on the said
line then leaving the out lines of the said
Tract and runing thence south 53º East
112 poles to a white oak bush on the edge
of a field then south 38 3/4 east 66 poles
to three hickory bushes on the west side
of wood fields branch, on the third line
of the original, then reversing the original
lines to the beginning containing one hundred
acres of Land more or less, and all houses,
buildings, gardens, orchards, yeards, meadows,
trees, woods, underwoods, ways, paths, waters,
water courses, profits, commodities, hereditaments,
and appurtinances whatsoever to the said
premises hereby granted, belonging or in
any wise appurtaining and the reversion and
versons remainder and remainders rents, ??
and profits thereof, and every part and parcel
thereof: To have and to hold the said Tract
of Land hereditaments and all and singular
the premises before mentioned with their
and every of their appurtinances unto him
the said George Mong his heirs and assignes
to the only proper use and behoof of him
the said George Mong his heirs and assings
forever. And the said Henry Whiteneck for
himself his heirs Executors and administrators
doth covenant and grant to and with the said
George Mong his heirs and assigns that he
the said Henry Whiteneck and his heirs, the
said tract or parcel of Land hereditaments
and all and singular the premises before
mentioned with every of their appurtinances
unto him the said George Mong his heirs and
assigns against the claim and demand of him
the said Henry Whiteneck and Margaret his
wife and their heirs and all and every other
persom and persons whatsoever shall and will
warrant and forever hereafter depend by these
present and the said Henry Whiteneck and
Margaret his wife doth hereby further covenant
promise and agree to and with the said George
Mong his heirs and assigns that they the
said Henry Whiteneck and Margaret his wife
and their heirs shall and will at any time
hereafter at the reasonable request and at
the cost and charges in the law of the said
George Mong his heirs or assigns make execute,
or cause to be made done and executed any
further lawfull act, Deed, conveyance, and
assuring the hereby bargained and sold Land
and premises. In Witness whereof the said
Henry Whiteneck and Margaret his wife have
hereunto set their hands and seals the day
and year first above written.

bargained and sold Land & premises.

The commonwealth of Virginia to David Hunter,
William Riddle, and James Anderson gentlemen
Justices of Berkeley county greeting. Whereas
Henry Whitneck and Margaret his wife by their
certain Indenture of bargain and sale bearing
date the 24th day of November 1798 have sold
and conveyed unto George Mong the fee simple
Estate of and in a certain Tract of Land
lying Lying (sic) and being in the said county
of Berkeley containing one hundred acres
and whereas the said Margaret cannot conveniently
travel to the court of our said county to
acknowledge the same: therefore we command
you or any two or more of you that you personally
go to the said Margaret and receive her acknowledgment
thereof and examine her privately and apart
from her said husband, whether she doth the
same freely and voluntarily without his pursuasions
or threats and whether she is willing the
same shall be Recorded in our said county
court together with this commission annexed
and when you have received her acknowledgement
and examined her as aforesaid that you distinctly
and plainly certify us thereof under your
hands and seals sending them there this writ
and the said Indenture Witness Henry Bedinger
clerk of our said court at the court house
aforesaid the 24th day of November and in
the 23rd year of this commonwealth.

In obedience to the within dedimus to us
directed we have waited on the within named
Margaret Whiteneck and examined her privately
and apart from her husband who acknowledged
that she signed the within mentioned willing
without the threats or pusuasions of her
husband and that sh is willing the same should
be Recorded in the county court of Berkeley
Given under our hands & seals this 24th
day of November 1798.

At a court held for Berkeley county the 24th day of December 1798 this Indenture and the receipt thereon endowed were proved by the oaths of Peter Durst, William Riddle, and James Anderson three of the Witnesses thereto which together with the commission annexed for taking the acknowledgement and privy examination of Margaret the wife of the said Henry Whiteneck and the certificate of the executor thereof endorsed are ordered to be recorded by the court.
