The Petition of David Dougherty, Administrator of all and singular the Goods, &c that were of John Daugherty, late of Montgomery Township, in said county, decd who died intestate humbly sheweth: That the said intestate left issue twelve children, to wit: Joseph, Samuel, Mary Jane intermarried with Jacob Buterbaugh, Margaret, David, James, John, Cyrus, Albert, Louis, Mary Ann & Sarah Elizabeth, the last seven of whom are in thier minority: That the personal estate of said intestate is insufficient for the payment of his debts as by the account herewith produced appears. And that the said intestate died seized in his demeane as of fee of and in as certain tract of Land, situate in Mongomery Township, Indiana County, adjoining lands of John Miller, David Daugherty, John Roley & Eduard Ruffner, containing fifty acres, more or less, ten acres of which are cleared, with a heived? log house and cabin barn therin erected. Your Petitioner, therefore prays your Honors to grant him an order to make sale of the said tract of land for the purposes aforesaid, and he will ever pray, &c.
