Last Will of Mary E. Whitnah

I, Mary E. Whitnah, of the City of Canton, in the County of Fulton and State of Illinois, make my last will and testament as follows, hereby revoking all former wills made by me:

First:-I appoint my son, Chester L. Whitnah, of the said City of Canton, executor of this will and in case of the death or resignation of said Chester L. Whitnah, then my daughter, Perle Rohrer, is hereby appointed executrix of this will.

Second:-I direct my executor or executrix to pay all my just debts and funeral expenses out of my estate as soon as practicable, and that my executor or executrix cause a suitable stone or monument to be placed to mark my last resting place costing not to exceed the sum of Five Hundred Dollars.

Third:- I give, devise and bequeath all the rest, residue and remainder of my estate, both real, personal and mixed, of whatsoever kind or nature and wheresoever situated, whether owned by me now or acquired by me hereafter, share and share alike, to my two children, Chester L. Whitnah and Perle Rohrer, for life, and to remain in trust in the hands and under the management and control of my said executor; my executor to pay to each of said children during their life the one half of the net income from said property, payable anually; and if either said Chester L. Whtinah or Perle Rohrer die without issue, him or her surviving then the survivor of my said children to receive the whole of said net income; If said Chester L. Whitnah die leaving issue him surviving then I give, devise and bequeath the full one half of the said rest, residue and remainder of my property to the said issue of the said Chester L. Whitnah, in equal shares; if the said Perle Rohrer die leaving issue her surviving, then I give, devise and bequeath the full one half of the said rest, residue and remainder of my property to the said issue of the said Perle Rohrer, in equal shares; if either of my said children die without issue and the survivor die leaving issue him or her surviving then I give, devise and bequeath to the said issue of said surviving child the whole of the rest, residue and remainder of my property; if both the said Chester L. Whitnah and Perle Rohrer die without leaving issue either of them surviving, then I give the rest, residue and remainder of my property to the Trustees of Eureka College (of the Christian Church) of Eureka, Illinois, to be added to the permanent endowment fund of said College.

Fourth:- Hereby giving and granting unto my said executor Chester L. Whitnah and also to said Executrix, Perle Rohrer, in event she is acting, full power and authority to sell and convey any and all of my said real estate at public or private sale and upon such prices and terms as said executor or executrix may deem best and account for the proceeds of any real estate so sold as personal property of said estate.

In witness thereof, I have hereunto set my hand and affixed my seal this Nineteenth day of March, A:D: 1900.

The above instrument consisting of two sheets was at the date thereof, signed, sealed, published and declared, by the said Mary E. Whitnah, as and for her last will and testament, in presence of us, who, at her request, and in her presence and in the presence of each other, have subscribed our names as witnesses thereto, believing the said Mary E. Whitnah to be, at the time of so subscribing our names as witnesses aforesaid, of sound mind and memory.
