This Indenture made this 16 day of September in the Year of our Lord One thousand eight hundred & six Between William Burnes Senior of the County of Berkeley & Commonwealth of Virgiia of the One part & John Whiteneck of the Aforesaid County & State of the other part. Witnesseth that for and in consideration of the sum of three hundred Dollars Current money of the United States to the said William Burnes in hand paid by the said JohnWhiteneck At or before the sealing & Delivery of these Presents the Receipt whereof he doth herby Acknowledge and thereof doth Release Acquit & Discharge the said John Whiteneck his Exors. and comrs. by these presents He the said William Burnes has granted bargained and sold and by these presents do grant bargain & Sell unto the said John Whiteneck and his heirs, Exors., admrs., & asigns, forever a Certain Lott or tenement of Land situate lying & being in the Town of Martinsburg in the county and commonwealth aforesaid, known on the General plan of the said Town by Mº 240 which said Lott or tenament of Land was conveyed by Deed under the Hands & Seals of Martin Tickus and Luvenia his wife bearing Dat the 2d day of Novermber in the year of our Lord One thousand Seven hundred & ninety Six and bounded as follows viz-- Beginning at a Stake at the intersection of Back Street with Burk Street then southerly with Back Street 200 feet to a stake at the said Street Corner to Lott No 206 thence leaving said stree and running Eastwardly With the said Lott 103 feet to a stake corner to Lott No. 231 thence with the said Lott Northerly 200 feet to a stake at Burk Street thence with Burk street 103 feet to the Beginning Which said Lott was originally conveyed to the said Martin Tickus by Deed of Bargain and Sale under the hands and seals of the Trustees of the said Town bearing date the 23d day of September 1795 which will more fully appear by a Reference to the Records of the Aforesaid County court . And all houses buildings Orchards Ways Waters Water Courses profits Commodities heriditaments and appurtenances whatsoever to the said premises hereby granted or any part therof belonging or in any wise appertaining & the reversion and Reversions Remainder & Remainders Rents Issues and Profits thereof and also all the Estate Right Title Material use Trust Property Claim and Demand whatsoever of him the said William Burnes of in and to the said premises and all Deeds Evidences and Writings to ?? or in any wise concerning the same. To have and to hold the Lands hereby Conveyed and all and Singular other the PRemises hereby granted and every part and Parcel therof with their and every of their appurtenances unto the said John Whiteneck his heirs and assigns forever to the only proper use and behoof of him the said John Whiteneck hi heirs and assigns forever. And the said William Burnes for himself his heirs Executors and Administrators doth covenant promise and grant to and with the said John Whiteneck his heirs and assigns by these Presents that the said William Burnes Sen. now at the time of sealing and delivering of these presents is seized of a good sure perfect & indefeasible Estate of inheritance in fee simple of and in the premises hereby granted & that he has good power lawful and absolute authority to grant and convey the same to the said John Whiteneck in manner & form aforesaid. And that the said premises now are & forever hereafter shall remain and be free and clear of and from all former and other gifts grants Bargains Sales Dower Right & Title of Dower judgements Executions Titles Troubles Charges and incumberances whatsoever made done committed or suffered by the said William Burnes, Sen. or any person or persons whatsoever (the Land tax imposed by Law Only excepted and forepraised. And Lastly that the said William Burnes Sen. & his heirs all and Singular the Premises hereby granted & Released with the appurtenances unto the said John Whiteneck his heirs and assigns against him. the said William Burnes Sen. & his heirs and all & every other Person or persons whatsoever shall warrant and forever defend by these presents.
