Last Will and Testament of Joseph Chester Whitnah

I, Joseph Whitnah, of the Township of Canton, County of Fulton and State of Illinois, hereby make, publish, and declare this my last will and testament hereby revoking any and all other wills heretofore by me made.

It is my will that all my just debts be paid by my executor as soon after my death as possible and that my body be buried, in a plain and substantial coffin and that all flowers be omitted after my death, by the side of the remains of my wife in the Dunkard cemetary in Farmington Township and a suitable monument erected at the grave.

I give and bequeath to my daughter-in-law, Samatha Whitnah, all the household goods and furniture in the dwelling formerly my home, now deeded to her, and Five Hundred ($500.00) Dollars, and it is my wish that my executor pay the said Samantha Whitnah the Five Hundred Dollars out of the first funds coming into his hands from my estate.

It is my will that my executor sell all personal property belongin to me, except that heretofore bequeathed to Samantha Whitnah, as soon after my death as consistant and best and divide the money received from the sale of said personal property as hereinafter directed.

It is my wish, and my executor is hereby instructed to carry it out, that the Southeast quarter of the Southeast quarter of section number Three (3) in Township Seven (7) North, in Range Four (4) East of the Fourth Principal Meridian in Fulton County, Illinois, be sold by my said executor as soon after my death as he may deem best, but within two years thereafter, and the funds received from sale of said land and personal property heretofore mentioned, after the bequest to Samantha Whitnah, expense of sale and administration have been paid, be at once divided and paid out by him as follows:

One third to my daughter, Ellen Whitnah Nebergall,
One third to my son, John L. Whitnah, and
One third to my grandaughter, Mrs. Birdie Campbell as Trustee for the use and benefit of my son Henry C. Whitnah and it is my wish that these funds shall be expended by my grandaughter for my son Henry C. Whitnah or paid to him as she deems necessary. Should there be any money remaining in this trust fund for the use of my son Henry C. Whitnah after his death, it is my wish that my said grandaughter, Mrs. Birdie Campbell, shall be paid a reasonable sum for her services as said Trustee and that the remainder of said Trust fund shall be divided equally among the then living heirs of my son Henry C. Whitnah share and share alike. It is my wish that my grandaughter, Mrs. Birdie Campbell, serve as Trustee of this fund without bond.

Lastly, I hereby nominate and appoint my son, John L. Whitnah, executor of this my last will and it is my wish and will that he serve as such without bond.

In witness whereof I have signed, sealed, published and declared this instrument as and for my last will, at the City of Canton, Illinois, on this 30th day of May A.D. Nineteen hundred and sixteen (1916).

Nineteen hundred and sixteen signed and sealed this instrument, at the City of Canton, Illinois, and declared the same as and for his last will; and we, at his request and in his presence and in the presence of each other, have hereunto written our names as subscribing witnesses.
